If you have failed to file a required tax return or have not reported all of your income for prior years, you should seek the assistance of an attorney with experience in taxpayer defense work. Although CPAs enjoy a limited amount of client confidentiality in dealing with tax clients, attorneys can provide taxpayers with a much greater degree of confidentiality regarding any possible criminal issues. The penalties for failing to file various returns involving foreign investments and/or entities can be very severe. If you meet with an attorney and then decide not to file delinquent returns on a voluntary basis, the attorney can't be required to divulge your conversations with him or her. If you have the same discussions with an accountant and choose not to proceed, if the IRS should find out (somehow) the accountant could be required to disclose the discussions you had with him or her. While the accountant is not required to inform the IRS of your conversations and is prohibited from doing so by professional ethics, the accountant can be required to disclose such information under a court order. If you are thinking that there is no way the IRS would know that had consulted with an accountant, look up "Murphy's Law" on the Internet.
